SOUTHERN AUCTION COMPANY LLC AUCTION TERMS & CONDITIONS —
READ BEFORE REGISTERING OR BIDDING
By registering to bid, placing a bid, or participating in any auction conducted by Southern Auction Company LLC (“Auctioneer,” “Company,” “we,” “us”), you agree to be legally bound by these Terms & Conditions.
AGENCY DISCLOSURE – AUCTIONEER REPRESENTS THE SELLER Southern Auction Company LLC acts solely as agent for the Seller/Consignor. The Auctioneer does not represent the Buyer in any capacity. No fiduciary or advisory relationship exists between Auctioneer and Buyer.
BUYER’S PREMIUM – AUCTION HOUSE FEE A Buyer’s Premium will be added to the final high bid (“Hammer Price”). This premium is a fee paid to the auction house for conducting the auction on behalf of the Seller and does not constitute a service to the Buyer or create any agency relationship. Buyer’s Premiums may be subject to sales tax where applicable. Example a $100.00 high bid will have a buyers premium resulting in a final purchase price of $115.00.
AS-IS / WHERE-IS – NO WARRANTIES All property is sold AS-IS, WHERE-IS, with all faults and defects. No warranties or guarantees are made, express or implied, including merchantability or fitness for a particular purpose. Condition statements are opinions only and not statements of fact. Southern Auction Company LLC assumes no responsibility for errors or omissions.
PREVIEW & INSPECTION Buyers are encouraged to inspect items during posted preview periods. By bidding, Buyer accepts the item in its existing condition whether inspected or not.
PHOTOS & DESCRIPTIONS Bids are placed on written descriptions, not photographs. Photos are for reference only. Items shown together may be sold separately unless stated otherwise.
REGISTRATION & BIDDING All bids are irrevocable and constitute a binding contract if accepted. Auctioneer reserves the right to approve or revoke bidding privileges at its discretion.
ONLINE AUCTION FORMAT Auctions may feature staggered or extended closings. Bid notifications are a courtesy only. Buyers are responsible for monitoring their bids.
PAYMENT TERMS Full payment is required by the deadline stated in the auction listing regardless of pickup time. Failure to pay may result in penalties, resale of items, or loss of bidding privileges.
SALES TAX Applicable sales tax will be collected unless valid exemption documentation is provided prior to checkout. No refunds of tax will be issued after auction close.
LOAD-OUT & REMOVAL Buyers must remove items within the stated time frame and provide all labor and equipment. No storage or alternate pickup arrangements are provided.
ABANDONED PROPERTY Items not removed by the deadline are deemed abandoned and may be resold or disposed of without refund. Buyer may lose future bidding privileges.
NO RETURNS – ALL SALES FINAL All sales are final. No refunds, exchanges, or adjustments will be made for any reason.
LIMITATION OF LIABILITY Auctioneer shall not be liable for errors, omissions, missed bids, technical issues, or damages after the sale.
GOVERNING LAW These Terms & Conditions are governed by the laws of the State of Louisiana, with venue in Calcasieu Parish.
ACCEPTANCE OF TERMS By registering or bidding, Buyer affirms acceptance of these Terms & Conditions and acknowledges each successful bid is a legally binding obligation.
